The following resolution was offered by Deputy Mayor Kosmerl and seconded by Trustee Reisdorf:

RESOLUTION

WHEREAS, there is to be held during the coming official year the following meetings:

 a. Annual Meeting and Training School conducted by the New York Conference of Mayors and Other Municipal Officials for municipal officials;
 b. Three meetings of the Wyoming County Village Association;
 c. Monthly meetings of the Mutual Aid Group made up of executives from County Police Agencies;
 d. Quarterly meetings of the WNY Chiefs Association;
 e. Semi-annual and Annual Meeting of the Municipal Electric Utilities Association;
 f. Meetings of the Arcade Chamber of Commerce, Merchant’s Committee and Beautification Committee;
 g. Semi-annual and Annual meeting of the New York Municipal Power Agency;
 h. New York State Conference of Mayors and other Municipal Officials Municipal Officials’ Workshop;

NOW, THEREFORE BE IT RESOLVED:

 Section 1. That the Mayor, Deputy Mayor, Trustees, Superintendent, Clerk-Treasurer, Deputy Clerk-Treasurer, Deputy Village Clerk Temporary, Chief of Police, and Police Sergeant are hereby authorized to attend the aforesaid meetings.

 Section 2. That this resolution shall take effect immediately.

The regular meeting of the Board of Trustees followed the annual meeting.

REPORT ON CLERK OF THE COURT

Justice Bell-Beyer presented a favorable report of the newly hired Clerk of the Court. She commented that Gill learns very quickly, asks sophisticated questions, recognizes and corrects her own mistakes, meets the public well, and is pleasant on the phone. Justice Bell-Beyer also expressed "that we are doing things we haven't done before," and feels "we are ahead of schedule" (with the training process).

PERMISSION TO ATTEND SEI 2005 USER GROUP MEETING

Motion by Deputy Mayor Kosmerl and seconded by Mayor Doster, and unanimously carried permission be granted to Gill Moore to attend the Service Education, Inc. (SEI) 2005 User Group Meeting on Thursday, April 21, 2005 at the Victor Town Hall.

ADOPT CLERK OF THE COURT EMPLOYEE POLICY

Motion by Deputy Mayor Kosmerl, seconded by Mayor Doster, and unanimously carried the Clerk of the Court Employee Policy be adopted as presented.

PRESENTATION AND DEMONSTRATION BY KVS

Ed Warnke, CPA/CEO and Bill Becker, Regional Marketing Manager demonstrated Cyberquery, an adhoc report writing and query tool developed by Cyberscience Corporation. Through the report writer, Village of Arcade employees will have the ability to create and generate custom reports, which can be printed, exported to Microsoft Excel, or published in HTML format for posting to a website.

PERMISSION TO SIGN

The following resolution was offered by Trustee Ely and seconded by Deputy mayor Kosmerl:

RESOLUTION

WHEREAS, the State has the authority to regulate and provide funding for the establishment and operation of program services and desires to contract with skilled parties possessing the necessary resources to provide such services, and

WHEREAS, the State of New York Division of Criminal Justice Services has awarded a grant to the Village of Arcade Police Department in the amount of $5,000 for the purchase of new portable radios for the officers,

NOW, THEREFORE, Be It Resolved, that Mayor Michael R. Doster be granted permission to sign the proposed Grant Award between the Division of Criminal Justice Services and the Village of Arcade.

PERMISSION TO ATTEND TRAINING

Motion by Mayor Doster and seconded by Deputy Mayor Kosmerl, and unanimously carried permission be granted to four full-time police officers to attend Interactive Simulation Training to be held at the Village of LeRoy Police Department on May 10-12, 2005. The training will be offered in two-hour blocks (beginning at 8:00am up to 10:00pm) to allow agencies flexibility in scheduling officers participation.  The simulation has numerous scenarios, from felony stops to court room security. The training forces officers to use cover and concealment, as the simulator is equipped with a gun which projects Teflon balls during training.  The system incorporates all the hard edges and uncertainty of real operational situations, the judgement calls, the potentially deadly mistakes, indecision, sudden fear, partial understanding, blindside surprise, eye-blink response, and life or death choices.

ADOPT 2005-2006 BUDGET

The following motion to adopt the amended 2005-2006 budget was offered by Mayor Doster and seconded by Deputy Mayor Kosmerl:

RESOLUTION

A Resolution adopting a budget for the fiscal year commencing June 1, 2005 and ending May 31, 2006 making Appropriations for the conduct of the Village Government and establishing the rates of compensation for officers and employees for such period.

WHEREAS, the Board of Trustees have met at the time and place specified in the notice of public hearing on the tentative budget and heard all persons desiring to be heard thereon, now, therefore be it:

RESOLVED, That the tentative budget as hereinafter stated in column titled “Adopted” on Schedule 1A, Schedule 1F, Schedule 1G, Schedule 2A, Schedule 2F, Schedule 2G, and Statement 1 covering general, electric, water, and sewer departments, together with the amounts set forth in Statement L as required for the payment of principal and interest on indebtedness, be and they thereby are appropriated for the object and purpose specified and the salaries and wages stated in Schedule 5 of such budget shall be and hereby are fixed at the amount shown therein effective June 1, 2005.  (The complete budget is on file in the Village Clerk’s Office.)

The following resolution was offered by Mayor Doster and seconded by Trustee Ely:

RESOLUTION

RESOLVED:  That the tax for the fiscal year starting June 1, 2005 upon the 1st completed assessment roll of the Village of Arcade, be and the sum hereby levied as shown by the budget in the sum of one million, fifty-five thousand, five hundred and ninety-five dollars ($1,055,595).  The amount so levied being the amount of the budget less the estimated revenues and appropriated cash surplus and appropriated reserves by section 5-508 of the Village Law, and be it,

FURTHER RESOLVED, That unless otherwise directed by the Village Board the following assessments due the Village as of May 16, 2005 be spread upon the 2005 Village Tax, to wit:

All invoice billings issued as of March 31, 2005 with interest to be added at the rate of twelve per centum (12%) per annum; all water taxes and sewer rents issued as of March 31, 2005 with interest to be added at the rate of twelve per centum (12%) per annum; and sums due for miscellaneous purposes, and be it,

FURTHER RESOLVED, That service for all delinquent water customers outside the Village whose accounts remain unpaid as of May 30, 2005 be discontinued without further notice and the Village Clerk is hereby instructed to issue shut off orders to the Superintendent of Public Works to discontinue the service of said customers on May 30, 2005.

AUDIT BILLS

Motion by Deputy Mayor Kosmerl, seconded by Trustee Reisdorf, and unanimously carried the Village bills be audited and paid and that the Clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.

RESOLUTION – PROPOSED LOCAL LAW 1-2005 – AMEND CHAPTER 52 SEWER RENTS

The following resolution was offered by Deputy Mayor Kosmerl and seconded by Mayor Doster:

RESOLUTION

WHEREAS, the Board of Trustees of the Village of Arcade have approved the 2005-06 Budget for the Sewer Department on April 19, 2005, and

WHEREAS, to balance the 2005-06 budget a rate increase is required that will increase all base rates by 4% and increase the amount charged per 1,000 gallons from $1.80 to $1.90 for the first 15,000 gallons and $1.95 above 15,000 gallons for Village customers and from $2.85 to $3.00 for the first 15,000 gallons and $3.10 above 15,000 gallons outside the Village; from $1.85 to 1.90 for the first 15,000 gallons and $1.95 above 15,000 gallons for Village mobile home parks and from, $2.95 to $3.10 for the first 15,000 gallons and $3.10 above 15,000 gallons for outside the village mobile home parks; from $1.85 to $1.90 for the first 15,000 gallons and $1.95 above 15,000 for Emkay Trading; and from $1.80 to $1.90 per 1,000 for the first 15,000 gallons and $1.95 above 15,000 gallons for Prestolite, and

WHEREAS, a draft copy of the proposed Local Law No. 1-2005 increasing the rates per 1,000 gallons was reviewed by each Board member at the board meeting held on April 19, 2005,

NOW, THEREFORE, Be It Resolved, that the Board publish Notice of Public Hearing to be held in accordance with the provision of Section 20 of the Home Municipal Rule Law, to be held on the 17th day of May, 2005 at 7:00 p.m. in the Village Board Room, 17 Church Street, Arcade, New York, at which time all interested persons will be heard.

PERMISSION TO ATTEND SPRING 2005 REGIONAL LOCAL GOVERNMENT WORKSHOP

Motion by Mayor Doster, seconded by Trustee Reisdorf, and unanimously carried permission be granted to the Planning Board Members, Zoning Board of Appeals Members, Mayor, Trustees, Superintendent of Public Works, and Zoning Officer to attend the Spring 2005 Regional Local Government Workshop on Friday, May 13, 2005 at the Burgundy Basin Inn in Pittsford, NY.

COMPREHENSIVE SIDEWALK PLAN

Superintendent of Public Works Kilburn distributed a list to the Board of sidewalks that need to be replaced.  The Board will review the list and will provide comments to be used in the development of the comprehensive sidewalk plan.

CLEANING CONTRACT - BID

Motion by Mayor Doster, seconded by Deputy Mayor Ely, and unanimously carried permission be granted for Superintendent of Public Works Kilburn to advertise for cleaning contract bid(s) and open said bid(s) on May 11, 2005 with Trustee Reisdorf in attendance. The bid will be awarded at the regular meeting scheduled for May 17, 2005.

SEASONAL CUSTOMERS MEMO

The Board will review the recommendation provided in the embedded cost of service study by Mr. Frank Radigan, Hudson River Energy Group.  The Board plans to make a decision based on the study at the May 3, 2005 regular meeting.

SAFETY AWARD – AMERICAN PUBLIC POWER ASSOCIATION

Superintendent of Public Works Kilburn announced that the Village of Arcade has received notice of a first place in Group B 2000 Electric Utility Safety Award by the American Public Power Association for safe operating practices. Further details will be published in the Arcade Herald.

PIONEER HIGH SCHOOL AGRICULTURE DEPARTMENT REQUESTS PERMISSION

Superintendent of Public Works Kilburn presented information received from the Environmental Science Class of Pioneer High School.  The class requested permission to repair, revitalize, and rejuvenate a nature trail at the Arcade Village Park.  A grant was received under the Learn and Serve America Program that requires a community service project be completed. The cost to the Village for this project will be minimal.  The Village Board requested additional information be obtained, expressed their desire to have the project completed by July 1, 2005, if approved, and plans to address this topic at the May 3, 2005 regular meeting.

STRATEGIC PLAN FOR DOWNTOWN ARCADE

Superintendent of Public Works Kilburn reminded attendees that comments on the draft Strategic Plan for Downtown Arcade were being collected at a 7:00pm meeting on April 27, 2005 at the VFW post in Arcade, NY.

PERMISSION TO ATTEND WESTERN NEW YORK WATER WORKS CONFERENCE

Motion by Deputy Mayor Kosmerl, seconded by Trustee Reisdorf, and unanimously carried permission be granted to the Superintendent of Public Works and one Water Department employee to attend the Western New York Water Works Conference on Wednesday, May 11, 2005 at the Holiday Inn Hotel & Suites in Batavia, NY. Topics of the conference include Lockout/Tagout, Personal Protective Equipment, Drinking Water Analysis, Containment Monitoring Systems, No Lead Brass Fittings and Valves, and Getting the Lead Out Revisited.

PROCLAMATION FOR MR. MERV PALMERTON

On behalf of the Arcade Volunteer Fire Department and Village of Arcade residents, Trustee Reisdorf approached the Board with a draft proclamation to declare Mr. Merv Palmerton day in the Village of Arcade.  Board members will review the draft proclamation and be prepared to discuss the final proclamation at the May 3, 2005 meeting.

Motion by Deputy Mayor Kosmerl, seconded by Mayor Doster, and unanimously carried the Board enter executive session to discuss performance of a specific employee.

Motion by Deputy Mayor Kosmerl, seconded by Trustee Reisdorf, and unanimously carried permission be granted to exit executive session.
