
The regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York was held on Tuesday, August 2, 2005 at 7:00pm there were:

NOTICE
Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 19th day of July 2005 and the same posted on the 19th day of July 2005.

Mayor Doster opened the meeting with the Pledge to Allegiance.
APPROVE MINUTES
Motion by Deputy Mayor Kosmerl and seconded by Trustee Ely, the minutes from the regular meeting held on July 19, 2005 be approved as presented by the Clerk.

CONTINGENCY PLAN
As requested by the Board, a contingency plan has been developed to cover expenses associated with sending Clerk of the Court Moore to the NYS Association of Court Clerks Annual Conference 2005 on September 25-28, 2005 in Niagara Falls, NY.

Motion by Mayor Doster, seconded by Deputy Mayor Kosmerl, and unanimously carried permission be granted to Clerk of the Court Moore to attend the NYS Association of Court Clerks Annual Conference 2005 on September 25-28, 2005 in Niagara Falls, NY. Funding for this conference will be made available either from the scholarship, if awarded, or the contingency plan identified above.
STATUS OF CRIMINAL DISPOSITION REPORTS FIELD BY OFFICE OF COURT ADMINISTRATION (OCA)
Clerk of the Court Moore reported that a representative from the OCA, came to the Village office on 08/01/05 – 08/03/05 to file criminal disposition reports from 1990-1999. She will return on 08/08/05 – 08/10/05 to continue filing the reports.
REPORT ON FABULOUS 50'S FESTITAL
Chief Laird summarized that the fabulous 50's festival went very well. The extensive planning of the festival proved beneficial. The weather was very cooperative and he estimated 3,000 people attended the festival on Friday evening. Chief Laird guessed there were more than 250 cars that participated in the classic car show. He reported that possible changes for next years event may include shutting down both west bound lanes for the car cruise from Pioneer Central School and utilizing the two east bound lanes for traffic.

PERMISSION TO SIGN AGREEMENT WITH NOBLE ENVIRONMENTAL POWER, LLC
Motion by Deputy Mayor Kosmerl, seconded by Trustee Ely, and unanimously carried permission be granted for Mayor Doster to sign the Noble Environmental Power Bliss Windfield Project agreement as detailed in correspondence from Glenn A. Sampson, Project Manager, dated July 20, 2005.
PERMISSION TO SIGN AGREEMENT WITH ATTORNEY REGARDING NOBLE ENVIRONMENTAL POWER, LLC
Motion by Trustee Ely, seconded by Deputy Mayor Kosmerl, and unanimously carried permission be granted for Mayor Doster to sign the agreement with Cohen, Dax, & Koenig, P.C., attorneys for legal services incurred with the Noble Environmental Power Bliss Windfield Project.
PERMISSION TO BID SIDEWALKS
Motion by Deputy Mayor Kosmerl, seconded by Mayor Doster, and unanimously carried permission be granted for Superintendent of Public Works Kilburn to bid the construction of sidewalks due to lack of manpower and time. However, the Board asked that Superintendent of Public Works Kilburn consult with Trustee Ely and Foreman Don Norton to discuss the specifications and concerns with Grove Street prior to bidding.
PERMISSION TO EXTEND RETIREMENT DATE
Motion by Mayor Doster, seconded by Deputy Mayor Kosmerl, and unanimously carried permission be granted for Clerk-Treasurer Offers to extend her retirement date to November 1, 2005 at which time her accrued vacation and compensated time would expire. The Village will incur hospitalization costs for the additional 1.7 months, however, no other benefits will be accrued.
PERMISSION TO APPOINT SUCCESSOR CLERK-TREASURER EFFECTIVE SEPTEMBER 1, 2005
Motion by Trustee Ely, seconded by Deputy Mayor Kosmerl, and unanimously carried permission be granted to appoint Pamela J. Beiersdorf as the successor Clerk-Treasurer effective September 1, 2005 and appoint Joanne E. Offers as the Deputy Village Clerk Temporary effective September 1, 2005 through November 1, 2005.
PERMISSION FOR SLEEP-OVER IN VILLAGE PARK
Motion by Mayor Doster, seconded by Deputy Mayor Kosmerl, and unanimously carried permission be granted to the Arcade Recreation to have a campout and sleep over in the Village park on Thursday, August 4, 2005.

Motion by Deputy Mayor Kosmerl, seconded by Mayor Doster, and unanimously carried the following budget adjustments be approved as presented by the Clerk.

AUDIT BILLS
Motion by Mayor Doster, seconded by Deputy Mayor Kosmerl, and unanimously carried the Village bills be audited and paid and that the Clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.
RESOLUTION LOCAL LAW – CHAPTER 7, "CARNIVALS AND TRANSIENT AMUSEMENT SHOWS"
The following resolution was offered by Mayor Doster and seconded by Trustee Ely:
RESOLUTION
WHEREAS, the Arcade Village Board has recommended that the Village of Arcade amend Chapter 7 of the Laws of the Village of Arcade entitled Carnivals and Transient Amusement Shows to more clearly define the application process, and
WHEREAS, the village has a fee schedule, all such fees for Carnivals and Transient Amusement Shows shall be moved to and included on the fee schedule maintained by the Village of Arcade, and
WHEREAS, a draft copy of the proposed Local Law No. 2-2005 amending Chapter 7 Carnivals and Transient Amusement Shows was reviewed by each Board member at the board meeting held on August 2, 2005,
NOW, THEREFORE, Be It Resolved, that the Board publish Notice of Public Hearing to be held in accordance with the provision of Section 20 of the Home Municipal Rule Law, to be held on the 16th day of August, 2005 at 7:00 p.m. in the Village Board Room, 17 Church Street, Arcade, New York, at which time all interested persons will be heard.
