At a regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, February 1, 2005 at 7:00 P.M. there were:

Mayor Michael Doster, Deputy Mayor Hugh Ely, Trustee Paul Burkett, Trustee Richard Kosmerl, Trustee Daniel Reisdorf, Superintendent Larry Kilburn

ALSO PRESENT

Police Chief John Laird, Deborah Titus – Arcade Herald, Sheri Bell-Beyer, Pam Beiersdorf, Fire Chief Neil Williams

NOTICE

Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 20th day of January, 2005 and the same posted on the 20th day of January, 2005.

PLEDGE TO ALLEGIANCE

Mayor Doster opened the meeting with the Pledge to Allegiance.

APPROVE MINUTES

Motion by Trustee Burkett, seconded by Trustee Kosmerl and unanimously carried the minutes from a regular meeting held on January 18, 2005 be approved as presented.

WINTERFEST KING/QUEEN CONTEST ESSAYS

Donna Schiener, Chairperson of the Winterfest Committee, asked that the board members once again judge the King and Queen contestant’s essays.  She presented each board member with their packet and asked that they have them completed by February 8, 2005.

NOTICE OF FINAL SPECIAL FRANCHISE ASSESSMENTS

The Clerk notified the board that Notice of Final Special Franchise Assessments has been received from the State Board of Real Property Services. There were no changes from the tentative assessments.

RESIGNATION – COURT/POLICE CLERK

Chief Laird informed the board of the resignation of Polly Boldt as Clerk of the Court effective on February 18, 2005. Motion was made by Mayor Doster and seconded by Trustee Burkett the board accept, with regret, the resignation of Polly. The motion was approved upon the following vote:

PERMISSION TO ADVERTISE FOR CLERK OF THE COURT

Chief Laird and Justice Bell-Beyer requested that the position that started as 25 hours a week and increased to 39 hours per week over time be made full-time.  After much discussion motion was made by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried permission be granted to advertise for a full-time position with an unadvertised salary range between $19,000 and $24,000 and an unadvertised benefit package with the salary and benefits package commensurate with experience.

BUDGET ADJUSTMENTS

Motion by Trustee Burkett, seconded by Mayor Doster and unanimously carried the following budget adjustment be approved as presented by the Clerk:

AUDIT BILLS

Motion by Mayor Doster, seconded by Trustee Burette and unanimously carried the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.

PERMISSION TO ATTEND SEMINAR

Motion by Trustee Kosmerl, seconded by Deputy Mayor Ely and unanimously carried permission be granted to two police officers (Matt and Ian) to attend a Standardized Field Sobriety Testing course at Erie County Central Police Services on April 12-14, 2005.

CHANGE DATE OF BOARD MEETING

Motion by Mayor Doster, seconded by Deputy Mayor Ely and unanimously carried the board meeting scheduled for March 15, 2005 be rescheduled to March 14, 2005 due to Village elections being held on March 15th.

SECTION 41j RETIREMENT SYSTEM

Clerk Offers requested that the board consider adopting Section 41j of the New York State Retirement System. The section is entitled “Application of Unused Sick Leave as Additional Service Credit”. This would allow a maximum of 165 unused, unpaid sick days to be credited to a person at retirement.  The board asked the clerk to contact the Retirement System for an estimate and the appropriate paper work.

EXECUTIVE SESSION

Motion by Mayor Doster, seconded by Trustee Burkett and unanimously carried the board enter executive session to discuss personnel issue with possible disciplinary action.

Motion by Trustee Reisdorf, seconded by Mayor Doster and unanimously carried Pam Beiersdorf be invited to attend the executive session as well as Superintendent Kilburn, Police Chief Laird and Clerk Joanne Offers.

Motion by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried the board exit executive session.

REPORTS RECEIVED

Village Justice and Acting Village Justice reports for the month of January were received, reviewed and placed on file.

Fire reports for the month of January were received, reviewed and placed on file.

Ambulance report for the month of January was received, reviewed and placed on file.

There being no further business to come before the board the meeting duly adjourned at 9:18 p.m. upon motion by Trustee Reisdorf and seconded by Mayor Doster.
